A judge this week entered a default judgment against the operator of a defunct Hutchinson stove restoration business, ordering the business owner to pay nearly $670,000 in restitution and penalties.
The ruling against Stevan Thomas Radakovich and Vintage Stoves includes $192,885 in restitution, ordered paid to 47 customers in 15 states and Canada, and $470,000 in civil penalties, resulting from a $10,000 fine for each customer.
The ruling also permanently enjoins Radakovich, who operated under the name Stevan Thomas, from engaging in business as a supplier in Kansas, said Kansas Attorney General's Office spokesman Matt Sinovic.
Prosecutors found Radakovich, Sinovic said, enabling the suit to go forward. He declined, however, to say where Radakovich is now living.
Radakovich had moved to Hutchinson from California in March 2005 and opened Vintage Stoves in a former warehouse at 201 N. Plum, repairing or restoring 1950s- and '60s-era gas stoves. The business required customers to pay half the purchase price when a contract was signed and the rest when a stove was finished. Customers also had to pick up shipping costs.
The business abruptly closed last year, after complaints had begun to pile up about undelivered stoves and a failure to refund money that had been paid.
The AG's office filed a consumer protection lawsuit in November, alleging multiple counts of "deceptive" or "unconscionable acts or practices" involving at least 50 consumers in the U.S. and Canada.
The court entered the default judgment after Radakovich failed to respond to the suit.
"The next step is now, of course, that our office will do everything in our power to collect this money from the company and Radakovich," Sinovic said. "Returning money to the consumers is the first priority. Any money collected will go to them first."
